Topic 1:
The American with Disabilities Act (ADA) was enacted
in 1990 to prohibit discrimination and guarantee that
people with disabilities have the same opportunities as
everyone else to participate in American life—
employment opportunities, to purchase goods and
services, and to participate in State and local
government programs and services. (www.ada.gov)
The ADA has been criticized that it lowers employment
opportunities for the disabled and increases the costs
of doing business which is particularly detrimental to
small businesses. Please address each of these criticisms
(including addressing arguments for and against each
criticism) and if either (or both) are realistic criticisms,
the benefit of the ADA overall in light of such criticisms.


Topic 2:
Religious discrimination involves treating a person (an applicant or employee)
unfavorably because of his or her religious beliefs. The law forbids discrimination
when it comes to any aspect of employment, including hiring, firing, pay, job
assignments, promotions, layoff, training, fringe benefits, and any other term or
condition of employment.
It is illegal to harass a person because of his or her religion. However, the rules
for what constitutes harassment are not that clear-cut. Harassment can
include, for example, offensive remarks about a person’s religious beliefs or
practices. Although the law doesn’t prohibit simple teasing, offhand comments,
or isolated incidents that aren’t very serious, harassment is illegal when it is so
frequent or severe that it creates a hostile or offensive work environment or
when it results in an adverse employment decision (such as the victim being
fired or demoted). (Source EEOC).
Develop a proposed solution to this problem that takes into account the view
that businesses and their employees need a bright line rule to determine if
behavior is legal or not. If you like, you may decide to develop a position to the
effect that there is no solution to the problem and that we have no choice but
to work on a case by case basis (please be sure to consider the issues with this
position).
